Abstract

Abstract Relationship domicile husband and wife in family represent contractual terms explaining about position of husband and wife as perpetrator in life of family. KHI Inpres No. 1/1991 is as base of yuridis normatif of marriage have arranged detailedly about spouse relationship, consisted of by obligation of husband and wife, dimiciling spouse, husband obligation, habitat, obligation of husband which have the wife to more than a, and the wife obligation. Despitefully, in KHI also discripts  that dimiciling spouse more limber in interpreting leadership of men for woman in family, as in balancing among rights and obligations by proporsional  with hitting creation of family sakinah, mawaddah and rahmah. Keywords : Spouse relationship, KHI Inpres No. 1/1991 Abstrak   Relasi kedudukan suami-isteri dalam keluarga merupakan hubungan hukum yang menjelaskan tentang posisi suami-isteri sebagai pelaku pada kehidupan rumah tangga. KHI Inpres No. 1/1991 sebagai salah satu landasan yuridis normatif perkawinan telah mengatur secara terperinci tentang relasi suami isteri, yang terdiri dari; kewajiban suami isteri, kedudukan suami isteri, kewajiban suami, tempat kediaman, kewajiban suami yang berpoligami, dan kewajiban isteri. Selain itu, dalam KHI juga memaparkan bahwa kedudukan suami isteri lebih lentur dalam mengartikan kepemimpinan laki-laki atas perempuan, yakni keseimbangkan antara hak dan kewajiban secara proporsional demi terciptanya keluarga sakinah, mawaddah dan rahmah. Abstract

Nikah sirri represent nuptials from conducted underhand or is not noted officially by state. Nikah sirri do not influence to legality of marry, because record keeping marry do not the inclusive of condition and foundation marry, along with opinion growth punish Islam really the nuptials record-keeping have very role is necessary happening of nuptials, releasedly of act marry serve the purpose of arm law when one of couple do not execute obligation. Although the nuptials record-keeping not yet been arranged in Islam Law, but to analysein perpective punish Islam needed by a dig method law (ijtihad) by moslem scholar, namely method Qiyas, Istihlah, al-Dzari'ah, Urf. Each regulation believed can uphold kindliness represent translating from Islam teaching values. Become according to ijtihad of moslem scholar have a nation that Nikah sirri law is illegal, and record keeping marry is obligation so that cause goodness at Islam people. According to contemporary moslem scholar have a notion that conducted better nuptials record-keeping is so that punished to marry validly according to religion and validate according to state.Kata Kunci : Nikah Sirri, Hukum Islam, Metode Penggalian Hukum.

Abstract

Al-Qur’an surah An-Nisa’ sentence 11 dan KHI of section 176 explaining that shares of between men and woman is two comparing one. Inheritance Law of principled Islam form proportional justice, and conception distributive justice its meaning a justice passing to each and everyone based by for its service or its rights.But in certain case, portion of division of heritage cannot that way, so long as there is certain reason is which might of according to Islam law, referred as by this of sulh ( settlement by agreement applying).Al-Qur’an surat An-Nisa’ ayat 11 dan KHI pasal 176 menjelaskan bahwa bagian warisan antara lakilaki dan perempuan adalah dua berbanding satu.Hukum kewarisan Islam berprinsip keadilan berimbang, dan berkonsep keadilan distributif (justice distributife) artinya suatu keadilan yang memberikan kepada setiap orang didasarkan atas hak dan kewajibannya. Namun dalam kasus tertentu,porsi pembagian warisan bisa tidak demikian, asalkan ada alasan tertentu yang diperbolehkan menuruthukum Islam, inilah yang disebut sulh (penerapan jalan damai).
